"TAQON" denotes the trade name under which the corporate developer, TAQON Powered by Intelligence, owns, controls, and operates the Platform. All right, title, and interest in the Platform “Marasi”, its underlying software, infrastructure, and operational workflows, are vest exclusively in said corporate developer.

"Seller" or "Merchant" shall mean any individual, sole proprietorship, or legal corporate entity that registers an account and establishes a digital storefront ("Shop") on the Platform for the purpose of advertising, offering, selling, or distributing products or services to end-users.

"Buyer" or "Customer" shall mean any individual or legal entity who accesses, browses, interacts with, or initiates or completes a transaction to purchase products or services from any Merchant’s storefront via the Platform (including the web interface and WhatsApp channels).

"Shop" or "Storefront" shall mean the distinct, digital space and interface allocated to, created, and managed by a Merchant on the Platform (including web-based landing pages at marasi.ai and corresponding automated setups on WhatsApp) through which the Merchant displays, markets, and sells its products or services.

"AI Assistant" shall mean the automated, algorithmic, and artificial intelligence driven features, modules, and tools integrated into the Platform (including both web and WhatsApp interfaces) designed to facilitate commercial operations, including but not limited to automated product description generation, voice command transcription, language translation, data analysis, and conversational commerce assistance.

" WhatsApp Services" shall mean the functionalities, automated features, and conversational commerce tools of the Platform that are deployed, transmitted, or made accessible to Users through the WhatsApp messaging application via official application programming interfaces (APIs), business accounts, or integrated automated chat systems.

Information We Collect

We collect information that you directly provide to us, data generated automatically during your use of the Service, and information transmitted to us via integrated third-party platforms.

3.1 Personal Data and Account Information

We collect personal data that you voluntarily submit to the Platform. This includes, but is not limited to:

Identity and Contact Data: Full name, business email address, physical/billing address, and primary telephone number.

Account Credentials: Unique usernames, email addresses, and encrypted authentication passwords.

Business and Merchant Profiles: Proposed shop/storefront name, physical business address, commercial description, inventory catalogues, and associated brand assets.

Payment and Financial Data: Billing details and bank account or merchant payout information.

Note: Sensitive payment card details (e.g., credit card numbers) are captured and processed securely by our PCI-DSS compliant third-party payment gateways and are never stored on Marasi’s servers.

Communication Data: Your WhatsApp phone number, official Meta account identifiers, and the text or audio contents of messages and voice commands transmitted to our automated WhatsApp interface or AI Assistant features.

3.2 Automatically Collected and Technical Data

When you navigate or interact with the Service, we (and our third-party service providers) automatically collect technical logs, which include:

Device and Network Information: Internet Protocol (IP) address, hardware device model, operating system version, browser type, language preferences, and general approximate geographic location data.

Usage and Telemetry Data: Granular metrics regarding your interactions with the Platform, including specific pages visited, features utilized, traffic data, time stamps, and session durations.

AI Feature Processing: To execute the specialized operations of our AI Assistant, including the processing of text prompts for product descriptions, the translation of store content, and the technical transcription of uploaded voice commands.

4.2 Administrative and Support Operations

Account Governance: To transmit vital administrative notices, system updates, security alerts, and modifications to our legal terms or corporate policies.

Customer Support: To diagnose system issues, investigate user inquiries, manage dispute resolutions between Buyers and Sellers, and deliver technical support.

4.3 Analytics, Security, and Legal Compliance

Optimization and Performance: To monitor, log, and analyse usage trends and behavioural patterns, allowing us to enhance user interfaces and platform ergonomics.

Fraud Prevention and Security: To detect, investigate, mitigate, and prevent security vulnerabilities, malicious activity, unauthorized platform access, or fraudulent transactions.

Regulatory Compliance: To enforce our Terms and Conditions, satisfy tax or accounting obligations, and comply with applicable statutory laws, lawful government requests, or court orders.

WhatsApp Business API Integration and Processing

The Platform utilizes the official WhatsApp Business API (operated by Meta Platforms, Inc.) to deliver conversational commerce capabilities. By activating or interacting with our WhatsApp Services, you acknowledge and agree to the following data practices:

Account Identification: We securely store your registered WhatsApp phone number and associated Meta account identifiers to establish, authenticate, and maintain the communications link between your account and the Platform.

Message Processing and Automation: Incoming and outgoing message text, media attachments, and structured chat logs are systematically processed to automate order management, update inventory tracking, and facilitate merchant-customer communications.

AI Voice Transcription: Audio transmissions or voice notes submitted through the WhatsApp interface may be routed to and processed by specialized third-party artificial intelligence services (such as natural language processing and speech-to-text APIs) for automated transcription, translation, and command execution.

Data Retention and History: Transactional chats and messaging histories are archived on our secure cloud infrastructure to provide continuous conversation history, audit logs, and customer support resolution.

Independent Third-Party Policies: WhatsApp is an independent service owned and operated by Meta Platforms, Inc. Your utilization of WhatsApp is inherently subject to the WhatsApp Business Terms of Service and the WhatsApp Privacy Policy. Marasi exercises no operational control over Meta's internal data processing workflows and disclaims all liability for Meta’s data handling.

Disclosure and Sharing of Your Information

We do not sell, rent, or trade your personal data to third parties for marketing or promotional purposes. However, we may disclose your information to restricted third parties under the following specific circumstances:

6.1 Authorized Service Providers: We share necessary data with third-party vendors, contractors, and operational partners who perform services on our behalf. These include, but are not limited to:

Payment Gateways: To securely process financial transactions.

Logistics and Delivery Providers: To arrange product shipments, calculate real-time delivery rates, and generate shipping labels.

Corporate Business Transfers: In the event that Marasi undergoes a corporate transition—such as a merger, acquisition, restructuring, reorganization, joint venture, assignment, or the sale of all or a portion of its corporate assets—user data and business profiles will typically be transferred as part of the transaction's due diligence and asset migration.

Statutory Legal Mandates: We reserve the right to disclose your information if required to do so by applicable laws, statutory regulations, or valid legal processes (including court orders or subpoenas), or when we reasonably believe such disclosure is necessary to protect the safety, rights, property, or operational security of Marasi, our Users, or the general public.

With Your Explicit Consent: We may share your information with external third parties for any other purpose when you provide us with explicit, informed consent to do so.

Marasi employs industry-standard technical, administrative, and physical security measures designed to protect your personal and business information from unauthorized access, loss, alteration, misuse, or disclosure. These safeguards include, but are not limited to:

Security Disclaimer: While we take commercially reasonable, institutional steps to lock down our perimeter, you acknowledge that no method of electronic transmission over the internet or computerized storage solution is entirely infallible. Consequently, Marasi cannot warrant or guarantee the absolute, impenetrable security of your data, and any transmission of information to our web or WhatsApp interfaces is executed at your own risk.

Data Retention and Account Deletion Protocols

Marasi retains your personal and operational information only for the duration necessary to fulfil the commercial purposes outlined in this Policy, or as mandated by applicable statutory retention laws.

8.1 Retention Criteria

We maintain your information to:

Service Continuity: Provision your active user accounts, host your digital storefronts, and power integrated WhatsApp or AI features.

Statutory Compliance: Satisfy corporate accounting, tax computations, financial auditing, and mandatory legal record-keeping requirements.

Dispute Resolution: Investigate e-commerce disputes, defend against legal claims, and enforce our platform Terms and Conditions.

Business Intelligence: Support aggregated platform analytics and user experience optimizations (in which case data is entirely stripped of personal identifiers).

8.2 Deletion Timelines

Upon a formal request for account termination or deletion, Marasi will systematically delete, purge, or irreversibly anonymize your personal information within thirty (30) business days.

Critical Legal Exception: Please note that certain transactional data including completed order invoices, payout ledgers, sales records, and historical communication logs required for tax compliance or fraud prevention cannot be immediately deleted and will be securely archived for the minimum period required by applicable corporate laws.

Your Data Protection Rights and Choices

If you are a resident of, or a business operating within, the United Arab Emirates (UAE), your personal data is protected under Federal Decree-Law No. 45 of 2021 on Personal Data Protection (PDPL). You have the right to submit requests to Marasi regarding the following privileges:

Right to Access Info: You have the right to request access to, and obtain a copy of, the personal data Marasi processes about you, your Shop, or your transactions.

Right to Data Correction: You have the right to request the immediate correction or completion of any inaccurate, outdated, or incomplete data linked to your account.

Right to Erasure (Deletion): You have the right to request the permanent deletion or anonymization of your data, subject to the mandatory UAE financial and tax retention exceptions outlined in Section 7.

Right to Data Portability: You have the right to receive your personal and product catalogue data in a structured, electronic, and machine-readable format.

Right to Stop or Restrict Processing: You have the right to object to or request the restriction of the processing of your data in specific cases, including where data is processed for direct marketing, automated decision-making, or via our AI Assistant features.

Right to Opt-Out of Marketing: You can withdraw your consent for promotional communications at any time by clicking the "Unsubscribe" link in our emails or replying "STOP" to our automated WhatsApp marketing broadcasts.

Essential Authentication: To securely maintain your active session state, keeping you securely logged into your Merchant dashboard or Buyer cart as you navigate between pages.

Preference Localization: To remember your selected system preferences, language choices, store layout configurations, and localized UAE marketplace settings.

Performance and Telemetry Analytics: To evaluate how users navigate the Platform, log page response times, and measure feature usage so we can continually optimize system infrastructure.

WhatsApp Interaction Tracking: To monitor communication statuses (such as message delivery and read indicators) to ensure our automated conversational commerce workflows trigger correctly.

10.2 Managing Your Preferences

You can control or restrict cookies directly through your web browser's native privacy settings. Please be advised that Tracking Technologies are fundamental to the operation of our infrastructure; if you choose to reject, block, or delete cookies, certain critical elements of the Service, including secure checkout features and persistent dashboard states, may experience diminished functionality or become entirely unavailable.

Merchant Responsibilities and End-Customer Data

Marasi provides an automated omni-channel e-commerce infrastructure. In delivering these services, a critical legal distinction is made between data relating to our registered business users ("Merchants") and data relating to the consumers who buy from those merchants ("Customers"):

Platform as a Data Processor: When a Merchant utilizes Marasi’s automated WhatsApp interfaces, storefront tools, or messaging pipelines to communicate with, manage orders for, or send digital receipts to their Customers, Marasi acts strictly as a Data Processor under United Arab Emirates (UAE) data protection frameworks.

Merchant as the Data Controller: The Merchant remains the primary Data Controller for all personal data belonging to their customers. The Merchant explicitly warrants, represents, and guarantees that they have obtained all necessary, explicit, and lawful consents from their customers to collect their mobile telephone numbers, process their transactional details, and broadcast automated updates to them via the WhatsApp Business API ecosystem.

Indemnification Shield: Marasi exercises no operational oversight over the source of a Merchant's customer list. Marasi explicitly disclaims all liability, legal penalties, or regulatory fines resulting from a Merchant’s failure to secure valid consumer consent, and the Merchant agrees to fully indemnify Marasi against any third-party customer privacy claims.

AI Feature Limitations and Machine Learning Processing

To power our automated storefront copywriting assistance, dialect translations, and vocal command transcriptions, the Platform transmits user-submitted prompts, inventory text, and WhatsApp voice notes to advanced artificial intelligence engines.

API Data Routing: These data payloads are routed via secure, encrypted Application Programming Interfaces (APIs) to our specialized AI sub-processors, including OpenAI.

Zero Model Training Guarantee: Marasi explicitly contracts with its AI sub-processors to ensure that your proprietary business data, store descriptions, and audio recordings are processed within secure, zero-retention developer sandboxes. Your inputs are used solely to execute your real-time requests and are never utilized, indexed, or stored by third-party providers to train public large language models (LLMs).

Technical Accuracy Disclaimer: Because generative artificial intelligence relies on statistical probability models, you acknowledge that automated text translations, product summaries, or vocal transcriptions may occasionally contain inaccuracies or machine hallucinations. The Merchant retains absolute responsibility for auditing all AI-generated content before publishing it to their public storefront or transmitting it to a Customer over WhatsApp.

Third-Party Integrations and Infrastructure Providers

To deliver a fully automated, omni-channel e-commerce experience, Marasi integrates with and relies upon specialized third-party infrastructure providers and sub-processors.

You acknowledge and agree that your data will be securely transmitted to and processed by these independent entities under the following scopes:

Financial Processing & Gateways: Online financial transactions and merchant payouts are securely managed by external payment systems, including but not limited to Stripe and PayPal. Marasi does not store or process raw credit card numbers; all payment actions are subject exclusively to the respective providers' privacy frameworks.

Conversational Interfaces: Communication networks, automated triggers, and customer chats are delivered via the WhatsApp Business API, owned and operated by Meta Platforms, Inc.

Cloud Infrastructure & Storage: Platform files, database tables, and system logs are securely hosted on cloud environments provided by Amazon Web Services (AWS).

Artificial Intelligence & Automation: Automated storefront copywriting, text translations, and audio voice-command transcriptions are powered via data pipelines connected to advanced language models, including OpenAI.

Independent Liability Disclaimer: These third-party networks operate independently from Marasi. They maintain their own standalone corporate structures, privacy protocols, and Terms of Service. Marasi exercises no direct operational control over their internal security protocols or data processing workflows. We strongly encourage you to review their independent privacy policies, as Marasi explicitly disclaims all liability for data losses, service downtime, or privacy breaches originating within third-party environments.

Minor’s Privacy and Age Restrictions

The Platform is strictly designed for commercial use by business entities and adult individuals. Marasi does not intentionally market to, target, or knowingly collect or process personal data from individuals under the age of sixteen (16) years. If you are a parent or legal guardian residing in the UAE and believe that a minor under your care has improperly disclosed personal information or created an account on our web or WhatsApp interfaces, please notify us immediately at [email protected] . Upon verification, we will take immediate, commercially reasonable steps to expunge and permanently delete such data from our primary servers and databases.

Cross-Border and International Data Transfers

Marasi operates its technical infrastructure via secure, global cloud networks. By interacting with the Platform, you acknowledge and explicitly consent that your information may be transferred to, stored in, and processed in countries outside of the United Arab Emirates (including, without limitation, data centres utilized by AWS, Meta, and OpenAI in the United States and Europe).

To safeguard these cross-border data flows, Marasi ensures that all international data processing operations comply strictly with the transfer mechanisms mandated by Article 22 and Article 23 of the UAE Personal Data Protection Law (PDPL). This includes enforcing robust data processing agreements, strict organizational security standards, and standard contractual clauses with our global service providers to ensure your information remains protected at an equivalent level of security regardless of geographic location.

Modifications and Updates to this Privacy Policy

Marasi reserves the right to review, amend, or update this Privacy Policy at any time to reflect shifting regulatory requirements under UAE law, operational updates, or adjustments to our technical architecture.

16.1 Notification Protocols

If we execute material changes to the structure or manner in which we process your data, we will alert you prior to the changes taking effect through one or more of the following communication pipelines:

Your continued access to marasi.ai, utilization of our AI Assistant features, or interaction with our WhatsApp messaging systems after such updates are published constitutes your explicit acknowledgment, understanding, and legally binding acceptance of the revised Privacy Policy terms.

Governing Law and Jurisdiction

This Privacy Policy and all matters relating to the collection, processing, and security of your data shall be governed by, and construed in accordance with, the federal laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai (including Federal Decree Law No. 45 of 2021 on Personal Data Protection).

Any disputes, controversies, or claims arising out of or relating to this Privacy Policy, our data practices, or a breach thereof, shall be resolved exclusively in accordance with the formal dispute resolution and binding arbitration procedures set forth in our Terms and Conditions.
